Any purchase process through the Website will be subject to these Terms and Conditions.

It is prohibited to buy products through the Website by minors unless prior consent of their parents, guardians or legal representatives is granted. In that case, the granting persons will be considered responsible for the acts or contracts carried out through the Website by minors in their charge.

BRUDY LAB, S.L. reserves the right to complete, update or modify these Terms and Conditions, the Privacy Policy and the Terms of Use of the Website, in which case the USER will be previously informed for its acceptance or rejection in case they turn out to be substantial or to individually affect the USER.

 

The completion of a purchase process requires the express and unlimited acceptance of these Terms and Conditions by the USER.

If for any reason the purchase of a certain product is subject to Terms and Conditions other than the present ones, BRUDY LAB, S.L. will inform the USER before starting the purchase process and ask for the express acceptance by the USER of the particular conditions that may apply to the affected products.

Through the Website the USER will be able to acquire a variety of medical nutrition products based on the benefits provided by DHA for human health.

In no case BRUDY LAB, S.L. will carry out the promotion or marketing of pharmaceutics or medicines since, in accordance with current regulations, this can only be carried out by pharmaceutical establishments.

Therefore, BRUDY LAB, S.L. will not provide treatments or professional guidance on symptoms or health or other problems that the USER may have before, during or after the use of the products acquired through the Website. In cases of adverse symptoms, intolerances, allergic reactions or similar, it is recommended that the USER immediately consults a doctor and suspends the use of the products.

The Website has a Section reserved for USERS who want to register with a private account, which can be accessed once the registration procedure has been completed.

The private account registration is personal and non-transferable, and only natural persons of legal age, who have not been legally incapacitated, can register.

The accounts registered by the USERS on the Website are private. The creation of an account requires an identifier (email address) provided and a password chosen by the USER.

Through the private account the USER can consult and modify the data for billing orders, delivery addresses, payment methods, purchase history and other information or preferences that allow personalizing the shopping experience.

The USER is responsible for the secure use of their identifier and password and to ensure the necessary measures to avoid the fraudulent use by third parties. The USER must use robust passwords that cannot be easily guessed or known by third parties (such as passwords specific to the Website) and modify them regularly.

Notify BRUDY LAB, S.L. of any modification concerning the provided data and to guarantee their veracity and accuracy.

BRUDY LAB, S.L. reserves the right to verify the accuracy of the data provided by the USER and to take the corresponding legal action, such as the right to deny registration or to unsubscribe the USER if BRUDY LAB, S.L. suspects that false or incomplete data have been provided.

The USER may unsubscribe as a registered USER at any time through written communication by mail or email to BRUDY LAB, S.L. under the contact information provided in the header, indicating the USER name and services you want to unsubscribe from. The USER can also specifically request the cancellation of our notifications by email through answering the same email or using the link indicated for this purpose in all emails they receive. USERS who have registered a private account and may wish to acquire products through the Website should do so by pursuing the following procedure:

The USERS can find a catalogue of our products in the "PRODUCTS" tab of the Website.

The USERS can add the products they wish to purchase to their cart by clicking on the "ADD TO CART" option and select the number of units wanted.

After selecting the products and number of units, the Website will allow the USERS to choose between the "CONTINUE SHOPPING" option, in which case the selected products will be added to your cart, or "SHOW CART", in which case they can see the list of products selected so far and the shipping costs, which will be calculated individually depending on the overall amount of the order and the place of delivery.

On the page "CART" the USER can change the number of desired units and, if necessary, return to the product catalogue to add new ones through the "CONTINUE SHOPPING" option.

In case there is any active promotion, the USER may enter their "COUPON CODE" to apply it to the order.

Once all the products the USER wishes to purchase are in the cart, the USER must select the "METHOD OF PAYMENT" from one of the following: (i) PayPal (for more information about PayPal click here: https://www.paypal.com/en/webapps/mpp/home   ); (ii) bank transfer (the Website will show the bank account details for the transfer, providing the order number and total amount, as well as the email address to which the receipt of payment must be sent); or (iii) credit card through the Redsys platform (for more information about Redsys click here: http://www.redsys.es/comercio-electronico.html ).

The USERS may consult and edit their "BILLING DATA" and "SHIPPING ADDRESSES" (which by default will be the same as the billing) and at any time see "SEE YOUR ORDER" by accessing  a file in which appear all the details related to it.

The USERS can access the "SPECIAL NOTES AND APPLICATIONS" section to make specific indications that may as far as possible facilitate the delivery by our parcel services.

Before clicking on the "CONFIRM PURCHASE" option, all USERS must confirm having read and accepted the present "Terms and Conditions" and the "Privacy Policy".

Once the order and payment have been processed, the USERS will receive a confirmation email and will also be able to consult the history of their orders made through the private account on the Website. The history can be accessed at any time and from any device by entering the registration email and password. If you did not receive the confirmation email, please check the spam or spam tray in your email account.

For all purposes, the purchase agreement shall be deemed concluded at the time it is delivered to the USER at the delivery address selected by the USER or to the person expressly or tacitly authorized by the USER.

The products purchased through the Website will be delivered by a parcel company ("Courier") chosen by BRUDY LAB, S.L. according to the delivery times and, where applicable, to the additional costs established in these Terms and Conditions and of which the USER will be in any case informed during the purchasing process.

Home delivery is available for shipments within the entire territory of the European Union (the "Territory"), although delivery times and costs may vary depending on the place of destination in accordance with these Term and Conditions.

The procedure for deliveries within the Territory is described below:

Once the purchase has been confirmed, BRUDY LAB, S.L. proceeds to the preparation of the order and forwards the delivery to the Courier.

Orders placed on Fridays after 12 o'clock, on Saturdays, Sundays or holidays, will be understood to be made at 09 o'clock on the following business day in Spain.

The delivery date forecast will be indicated to the USER during the purchase process. BRUDY LAB, S.L. will make every effort to deliver the products within the scheduled dates. However, in the event of exceptional circumstances or force majeure which are beyond the control of BRUDY LAB, S.L. and which may delay the foreseen delivery dates, such as, for example, but not limited to, difficulties of accessibility or connections to the place of delivery or other causes attributable to the Courier, BRUDY LAB, S.L. cannot be held responsible for late deliveries.

Delivery times will not include Saturdays, Sundays and public holidays in Spain, or, where appropriate, Saturdays, Sundays and holidays at the place of delivery or at the place(s) through which the order is transported until the place of delivery.

For deliveries outside the Territory, the USERS have to contact our staff through the contact information that appears on this Website, so that, where possible, we can customize the deadlines and costs of delivery in that specific case. If customs or customs duties are due for deliveries outside the Territory, they are the USERS responsibility, as well as it is the USERS responsibility, before making the purchase, to assure that the purchased products meet all the legal requirements in the respective region.

In accordance with the provisions of Article 23 of Law No. 34/2002 of July 11, 2002 on Information Society Services and Electronic Commerce ("LSSICE"), contracts concluded electronically will have all the expected effects by the legal system when consent and other requirements necessary for its validity are met

In all cases, the electronic support in which these Terms and Conditions are included will be made admissible as documentary evidence in case of controversy between the parties.

For these purposes, it will be understood that the monitoring of all phases of the purchase process and, where applicable, the payment of the corresponding economic amount, necessarily imply the provision of the consent required for the contracting.

In accordance with the provisions of article 27 of the LSSICE, all the purchase related information is made available to the USERS prior to the contracting procedure through the present Terms and Conditions. And specifically,  it is stated that:

All commercialized products are individually displayed and described on the Website (description, ingredients, nutrition information, mode of use, etc.), not including those characteristics that have not been expressly indicated in the product file.

A detailed description of the necessary purchase procedures has been included in these Terms and Conditions.

The USER may consult the history of their purchases through their private account on the Website and at any time may request BRUDY LAB, S.L. a copy of the document in which the details of the transaction are collected, as long as BRUDY LAB, S.L. is legally obligated to keep a copy of that transaction.

BRUDY LAB, S.L. will use all possible technical measures that are reasonably proportional to the type of transaction to detect errors in the data entry by the USER.

The contract will be formalized in Spanish.

The prices of all commercialized products are indicated next to their descriptive sheets and are always displayed in the legal currency of Spain: EUROS (€).

All displayed prices are final prices including the Value Added Tax (VAT) applicable in Spain at the time of purchase. The USER may at any time receive a detailed disaggregated version for all purchased products (tax base + applicable VAT).

In case the USER has a DISCOUNT COUPON, the code must be entered during the purchase process in the field provided for that purpose. The DISCOUNT COUPON must be entered before payments are made, otherwise the discount cannot be granted on that specific order.

In case of product promotions shown on the Website, the applicable final price will be clearly indicated, and, as the case may be, the limitations to which the promotion is subject (for example, to a specific term, or to a certain number of units, or until the existing stock is exhausted, etc.).

BRUDY LAB, S.L. will issue the invoice based on the data provided by the USER, who is responsible for their validity, legitimacy and accuracy. The invoice will be sent to the USER upon request by email once the purchase process has been completed and the payment verified.

The purchase will only be processed after BRUDY LAB, S.L. receives confirmation of the payment. If for any reason the transaction is denied by the payment platform, or if the order amount is not fully satisfied (including surcharges for management fees and bank transfer fees, if applicable), the purchase process will be suspended, informing the USER that the transaction has not been finalized.

By accepting these Terms and Conditions the USER gives their express consent to receive the invoice electronically. Once the USER requests the invoice, BRUDY LAB, S.L. will send it within a maximum period of seven (7) business days to the email address provided by the USER. If the USER wishes to receive a paper invoice, they can contact BRUDY LAB, S.L. providing the postal address to which it should be sent.

In accordance with current legislation, we indicate that once the invoice of a purchase process has been issued, the entered data can no longer be modified.

BRUDY LAB, S.L. reserves the right to deliver gift vouchers and/or promotional or discount codes to USERS and potential customers as deemed appropriate. Their use may be subject to minimum purchase amounts or other limitations about which USERS will be informed prior to their use.

Unless expressly stated otherwise, gift vouchers, promotional coupons or discount vouchers are not exchangeable in cash, cannot be accumulated and may only be used once.

The products are subject to the legal guarantees and responsibilities currently valid in Spain.

The USER will have a maximum period of 14 calendar days from the date of delivery to withdraw from the order without needing to state a reason.

The right of withdrawal must be communicated directly to BRUDY LAB, S.L. in accordance with the provisions of Articles 106 of the Royal Legislative Decree 1/2007 of November 16th, which approves the revised text of the General Law for the Protection of Consumers and Users and other complementary laws (hereinafter "General Consumers Law").

The cost of returning the products to BRUDY LAB S.L. will be borne by the USER.

For health protection and hygienic reasons in accordance with the provisions of the General Consumer Law [specifically, article 103, section e)], there is no right of withdrawal in distance sales cases where the products have been unsealed after delivery.

The restrictions mentioned in the previous sections do not impede the right of withdrawal within the time limits and manners provided by law, in relation to malfunctioned products or products with manufacturing defects which are not in the responsibility of or attributable to the customer.

Should any product show defects, flaws or lack of conformity, or is expired, please contact BRUDY LAB, S.L. immediately to indicate the procedure for its return. After verification of the alleged cause, the USER will not be charged for the return. To claim and enforce the guarantee, the consumer has a general term of two (2) years from the delivery of the product. If the defect or lack of conformity is manifested six (6) months or longer after delivery, the consumer must prove to the manufacturer or seller that the failure, defect or lack of conformity already existed when the product was delivered. The consumer has the obligation to inform the seller within two (2) months from the date on which said failure, defect or lack of conformity was discovered.

The products on the Website are subject to expiration dates. BRUDY LAB, S.L. guarantees that at the time of purchase the products have a sufficient period for their consumption in a usual way.

The parties undertake to comply with their legal obligations and the contractual obligations established in these Terms and Conditions. If a party does not fulfil any of its obligations or hinders compliance by the other party, the right of the other party to claim compensation for damages suffered would include both consequential damages and loss of profits.

The parties will be liable for the infractions they have personally incurred, holding the opposing party harmless against any damage caused to them by their fault or negligence.

These conditions are subject to Spanish law especially and without limitation, to the provisions of Law No. 34/2002 of July 11, 2002 on Information Society Services and Electronic Commerce (LSSICE), the Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, Law 7/1998, of April 13, on General Contractual Conditions, Law 7/1996, of January 15, on Retail Trade, Royal Decree 1487/2009, of September 26,  on Food Supplements, which transposes Directive 2002/46/EC  which establishes the regulatory framework at European level, Regulation (EU) 2016/679, of the European Parliament and of the Council, of April 27, 2016, regarding the protection of individuals with regard to the processing of personal data already the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation, RGPD), with its respective amendments in all cases, and the rest of the legislation of a general nature or of subsidiary application in conformity with the basic principles of organisation the Spanish legal system.
